Privacy Policy

This policy outlines how Fulcrum Technologies, Inc. (“Fulcrum” or “we”) collects, uses and shares your personal and other information that Fulcrum receives from various sources, including but not limited to websites, web and mobile applications, social media pages, e-mail messages, and offline sales and marketing activities (collectively, “Sources”).

Sources may provide links or the ability to interact with non-Fulcrum websites, services, social networks and applications. Clicking on those links or interacting with third parties will allow them to collect and share information about you. That information is beyond our control and outside the scope of this privacy policy.

Personal Information We Collect

Fulcrum may collect “Personal Information”, which is information that identifies an individual or relates to an identifiable individual. Personal Information may include, but is not limited to:

  • Your name and physical address, email addresses, and telephone numbers

  • Behavioral or demographic attributes, when tied to personal identifiers

  • Past transactional behavior

  • Information about your company such as the name, size and location of your company and your role within the company

Other Information We Collect

Fulcrum may also collect “Other Information”, which is information that does not reveal your specific identity or does not directly relate to an individual. Other Information may include, but is not limited to:

  • Unique IDs including from browser cookies or mobile device IDs

  • IP address and information derived from your IP address such as your geographic location

  • Exact or approximate geographic location based on GPS or other location services

  • Information about your devices such as browser or device type and version, operating system, user-agent strings, screen resolution, and your preferred language

  • Behavioral data about your usage of the Fulcrum websites and applications

  • The search terms you used to locate and navigate to our websites

In some cases, we may combine Other Information with Personal Information, such as deriving geographical location from your IP address and combining behavioral data about your usage of Sources with your name. If we combine Other Information with Personal Information, we will treat the combined information as Personal Information.

Information We Collect on Behalf of Customers

A company who has licensed Fulcrum’s products or services (“Customer”) may grant its employees, contractors, and other third parties access to Fulcrum services and applications on such Customer’s behalf (“Authorized Users”). If you are an Authorized User, our applications will collect and send various information about you to such Customer (or agent acting on their behalf) including but not limited to:

  • Username and password used to verify your identity

  • Physical address, email addresses, and telephone numbers

  • IP address and information derived from your IP address such as your geographic location

  • Exact or approximate geographic location based on GPS or other location services

  • Information about your devices such as browser or device type and version, operating system, user-agent strings, screen resolution, and your preferred language

  • Photos or documents that you may upload which may contain Personal Information

  • Any other business transaction data that you submit using our web or mobile applications

The use of this information is governed by the policies of the particular Customer and is outside the scope of this privacy policy.

How We Use and Share Personal Information

Fulcrum uses and shares Personal Information it collects (where allowed by law) in order to:

  • Process orders for products or services

  • Provide technical support

  • Notify you of product updates and bug fixes

  • Notify you of service disruptions, service windows or for other operational communication

  • Respond to your information requests or other general inquiries

  • Improve products and services

  • Tailor marketing and advertising communications

  • Interact with you on third party social media networks

  • With your consent, post testimonials that may contain your personal information

  • Protect our employees, facilities and operations

  • Obtain third-party services from vendors that provide services to Fulcrum including payment processing, order fulfillment, analytics, email delivery, customer service, IT services and other commercial services.

  • In the event of a reorganization, merger, sale, joint venture, assignment or transfer of all or a portion of our business, assets or stock, (including any bankruptcy or any similar proceedings) we may transfer the information we have collected to a relevant third-party

  • Comply with legal requirements

We may use, transfer and disclose Other Information we collect for any purpose except where restricted by law. If we are required by law to treat Other Information as Personal Information, then we will only use it in the same we are permitted to use and disclose Personal Information.

How We Collect Information

Fulcrum and our third party service providers may collect both Personal Information and Other Information from a variety of sources that generally fall into the following categories:

  • Direct data collection from your activities such as creating accounts, event registration, submitting inquiry forms, and raising support tickets.

  • Automated data collection including but not limited to tracking cookies, communication protocol information, tracking pixels and other automated data collection tools, as such tools may evolve in the future.

  • Publicly available data or data from third parties including social media, marketing lists or other data aggregators.

Privacy Choices

Fulcrum enables you to opt-out of marketing communication. Non-marketing communications may not be subject to opt-out. This includes communication related to sales transactions, order fulfillment, software updates, service availability, support tickets, or disclosure required by law.

Fulcrum may use third party lists to send communications about Fulcrum products and services. These lists are maintained by third parties. When we use such lists, the communication will include mechanisms to opt out of receiving Fulcrum marketing communication.

If you are an Authorized User with a Customer, then Fulcrum services and applications may send you e-mail or SMS notifications based on your notification settings and the business processes of such Customer. Those communications are governed by the Customer and not subject to this privacy policy.

Fulcrum mobile applications may send push notifications directly to your mobile device for the purposes specified in this policy. You may out-out of receiving push notifications by editing the notification preferences on your mobile device.

You may deny access to physical location information to Fulcrum mobile applications in your mobile device, although by denying this use you may be prevented from accessing certain services or content, such as when connecting to Fulcrum applications and services on behalf of a Customer that has mandated the use of location services.

Do Not Track

Some browsers have incorporated “Do Not Track” (DNT) features that can send a signal to the websites you visit indicating you do not wish to be tracked. Because there is not yet a common understanding of how to interpret the DNT signal, Fulcrum does not currently respond to browser DNT signals.. In the meantime, you can use other tools to control data collection and use, including the ability to opt out of receiving marketing communications from Fulcrum as described above.

Retention of Personal Information

Fulcrum will retain your Personal Information for as long as needed to provide you (or the applicable Customer when you are an Authorized User) with products and services; as necessary to comply with legal obligations; in order to resolve disputes and enforce agreements; and to the extent permitted by law. Because these needs can vary for different data types in the context of different products, actual retention periods can vary significantly.

Security of Your Personal Information

Fulcrum uses physical, electronic and administrative safeguards to protect your Personal Information from unauthorized access, use, or disclosure. However, due to computer hackers, electronic malfunctions, and other events, Fulcrum cannot guaranty that such safeguards will always protect such information.

Cross Border Transfer

Fulcrum has operations outside the United States. Please note that Personal Information may be transferred, accessed and stored outside the United States as necessary in accordance with this Policy.

Children’s Privacy

As a company focused on serving the needs of businesses, Fulcrum’s websites and services are not directed to minors and Fulcrum does not promote or market its services to minors. If you believe that we have mistakenly or unintentionally collected Personal Information of a minor without appropriate consent, please notify us immediately so that we may take corrective action.
